Terms of Service

These Terms of Service (the "Terms") are a public offer setting out the conditions on which the BlankTrail Proxy software and its associated user cabinet (the "Service") may be used, between the operator of the Service (the "Operator") and the user (the "User").

By using the Service the User accepts these Terms in full.

1. Definitions

Service — the BlankTrail Proxy software installed on the User's device, together with the user cabinet on the Operator's website.

Licence — the right to use the Service granted to the User on the conditions of the selected plan.

Licence key — the unique code identifying a Licence.

Device — the computer or other equipment on which a Licence is activated.

Cabinet — the section of the website available to the User after registration.

2. Subject of the Terms

2.1. The Operator grants the User a non-exclusive licence to use the Service to the extent defined by the selected plan, together with access to the Cabinet and to Service updates during the paid period.

2.2. These Terms are legally binding and are concluded when the User accepts them at registration.

2.3. The Service is provided "as is". All exclusive rights in the Service remain with the Operator; a Licence transfers no exclusive rights to the User.

3. Registration and account

3.1. To use the Service the User registers an account by providing an email address and a password.

3.2. The User is responsible for keeping the password secure and must not disclose it to third parties. Actions performed through the User's account are deemed performed by the User.

3.3. The User must notify the Operator immediately upon discovering unauthorised access to the account.

3.4. The Service is not intended for persons under 18 years of age.

4. Licence and its use

4.1. A Licence is valid for the paid period and may be activated on the number of Devices provided by the plan.

4.2. The User may deactivate a Device in the Cabinet, freeing the slot for another Device.

4.3. Service updates are provided to the extent corresponding to the User's plan.

4.4. The User must not transfer, resell, publish or otherwise make the licence key available to third parties without the Operator's written consent.

5. Plans and payment

5.1. Current plans and prices are published on the Operator's website.

5.2. Payment is made as described in the Cabinet. As of this redaction, payment is arranged with the assistance of the support team.

5.3. Promotional codes and special plans apply on the conditions stated when they are issued.

5.4. A Licence is activated once payment is confirmed.

6. Refunds

6.1. Payments are refunded within 3 (three) calendar days of payment where the Service does not work and the support team has been unable to resolve the fault.

6.2. To request a refund the User contacts the support team, describing the fault and the steps already taken.

6.3. No refund is made where access has been terminated because the User breached section 7 of these Terms.

7. Acceptable use

7.1. The Service is intended for lawful purposes, including:

  • testing and quality assurance of the User's own information systems;
  • automation of routine tasks on the User's own behalf;
  • collection of publicly available data to the extent permitted by applicable law.

7.2. When using the Service the User must not:

  • engage in deception, fraud or misrepresentation;
  • circumvent the anti-fraud controls of payment systems or financial institutions;
  • gain unauthorised access to the information systems or data of third parties;
  • send spam or distribute malicious software;
  • infringe the rights of third parties, including intellectual property rights;
  • take any other action contrary to applicable law.

7.3. The User is solely responsible for the purposes and consequences of their use of the Service, and for complying with the terms of any third-party resource they access.

8. Operator's rights and obligations

8.1. The Operator will provide access to the Service and the Cabinet during the paid period and support to the extent of the selected plan.

8.2. The Operator may change the functionality of the Service, publishing details of the changes on the website.

8.3. The Operator may carry out scheduled maintenance, giving advance notice where practicable.

9. Intellectual property

9.1. The Service is licensed, not sold, to the User.

9.2. The User must not decompile, disassemble or modify the Service, nor take any action aimed at circumventing its licensing protections.

9.3. Distribution and resale of the Service are permitted only under a separate agreement with the Operator.

10. Limitation of liability

10.1. The Service is provided "as is". The Operator does not warrant uninterrupted operation or that the User will achieve any particular result.

10.2. The Operator is not responsible for the acts of third parties, including decisions by owners of third-party resources to restrict access to them.

10.3. The Operator is not liable for losses arising from the User's breach of these Terms or of applicable law.

11. Suspension and termination

11.1. The Operator may restrict or terminate the User's access to the Service where the User breaches these Terms, in particular section 7.

11.2. Where access is terminated on the ground in clause 11.1, payments are not refunded.

11.3. The User may stop using the Service at any time.

12. Personal data

12.1. The processing of the User's personal data is governed by the Privacy Policy published at /privacy, which forms an integral part of these Terms.

12.2. By accepting these Terms the User confirms that they have read the Privacy Policy.

13. Changes to the Terms

13.1. The Operator may amend these Terms. Each redaction carries the number and effective date shown at the top of the document.

13.2. The current redaction is published at /terms. Continued use of the Service after a new redaction takes effect constitutes acceptance of the changes.

13.3. Redactions previously accepted by the User are retained by the Operator.

14. Disputes and governing law

14.1. These Terms are governed by the laws of the Operator's place of establishment.

14.2. The parties will seek to resolve disputes through negotiation. A claim sent to the address in section 15 is answered within 30 (thirty) calendar days.

14.3. If any provision of these Terms is held invalid, the remaining provisions continue in force.
